01Use of the Website

You may use the Website to learn about KenStack and to contact us about our services. You agree not to:

• Use the Website for any unlawful, fraudulent or harmful purpose.
• Attempt to gain unauthorised access to the Website, its servers or any connected systems.
• Introduce viruses, malware or any code designed to disrupt or damage the Website.
• Scrape, copy or harvest content or data from the Website by automated means without our written permission.
• Submit false information or impersonate another person or organisation through our forms.

02Enquiries and quotations

Submitting an enquiry, attending a strategy call or receiving a proposal or estimate does not create a contract between you and KenStack. Proposals and quotations are based on the information available at the time, are valid for the period stated in them, and may change if the scope changes.

A binding engagement exists only once both parties sign a written agreement, statement of work or accept a formal proposal in writing.

03Services and project agreements

Our AI development, software development, automation, consulting and related services are provided under a separate written agreement or statement of work. That agreement sets out the scope, deliverables, timelines, fees, payment terms, acceptance criteria, warranties, support and ownership of work products.

If anything in these Terms conflicts with a signed project agreement, the signed project agreement prevails for that project.

04Intellectual property

All content on the Website, including text, graphics, logos, the KenStack name and brand, images, videos, design and code, is owned by or licensed to KenStack and is protected by Indian and international intellectual property laws.

You may view and print pages for your personal or internal business reference. You may not copy, reproduce, modify, distribute or use our content for commercial purposes without our prior written consent. Third-party names and logos shown on the Website, including technology logos, belong to their respective owners and are used only to identify tools we work with.

Ownership of software, models and deliverables created for clients is governed by the relevant project agreement.

05Portfolio, testimonials and results

Case studies, project descriptions, testimonials and statistics on the Website reflect the experiences of specific clients and projects. They are provided for information and do not guarantee that you will achieve the same results. Outcomes depend on many factors, including your data, processes and market.

06AI systems disclaimer

AI and machine learning systems produce outputs based on probabilities and the data they are trained or grounded on. While we design systems for accuracy and reliability, AI outputs can be incomplete or incorrect. Clients remain responsible for reviewing AI-generated outputs and for decisions made using them, especially in legal, medical, financial or safety-critical contexts, unless a project agreement states otherwise.

07Third-party links and services

The Website may link to third-party websites and services such as LinkedIn, Instagram, YouTube and Facebook, and loads resources from third-party content delivery networks. We do not control these services and are not responsible for their content, availability or privacy practices. Your use of them is at your own risk and subject to their terms.

08Disclaimer of warranties

The Website and its content are provided on an "as is" and "as available" basis for general information. While we try to keep information accurate and up to date, we make no warranties, express or implied, about its completeness, accuracy, reliability or availability, or that the Website will be uninterrupted or error-free.

09Limitation of liability

To the fullest extent permitted by law, KenStack and its directors, employees and partners will not be liable for any indirect, incidental, special or consequential loss, or any loss of profits, revenue, data or business opportunities, arising from your use of, or inability to use, the Website or its content.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Liability relating to client projects is governed by the relevant project agreement.

10Indemnity

You agree to indemnify and hold KenStack harmless from any claims, losses, liabilities and expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Website.

11Privacy

Your use of the Website is also governed by our Privacy Policy, which explains how we collect and use personal data.

12Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms or the Website will be subject to the exclusive jurisdiction of the courts at Tiruchirappalli (Trichy), Tamil Nadu, India. Before going to court, both parties agree to try in good faith to resolve the dispute through discussion.

13Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. Continuing to use the Website after changes are posted means you accept the updated Terms.
